This paper attempts to clarify some issues about what is usually called “doxastic voluntarism”. This phrase often hides a confusion between two separate (although connected) issues: whether beliefis or can be, as a matter of psychological fact, under the control of the will, on the one hand, and whether we can have practical reasons to believe something, or whether our beliefs are subject to any sort of “ought”, on the other hand. The first issue -- which I prefer to (...) call the issue of volitionism about belief -- is psychological, and I take the answer to be negative, along the lines of the conceptual arguments against believing at will adduced by writers such as Bernard Williams. The second issue -- which I call voluntarism proper -- is normative, and the answer that I give is a qualified yes. Belief is not a matter of the will, although there are certain things that we ought to believe. (shrink)

This is a special issue of Disputatio on normativity and rationality. The idea for this volume originated after the fifth European Congress of Analytic Philosophy, ECAP5, which took place in Lisbon in August of 2005. This volume collects the contributions of John Broome, Pascal Engel, Kevin Mulligan, Josep Prades and John Skoruspki, who were speakers on that occasion. The common thread in the diverse talks suggested that a volume on the topic would be of general interest. This (...) common thread, which revealed itself naturally, testifies to issues hotly debated in recent years and also to the centrality of normativity in various philosophical areas. (shrink)

What is truth? What value should we see in or attribute to it? The war over the meaning and utility of truth is at the center of contemporary philosophical debate, and its arguments have rocked the foundations of philosophical practice. In this book, the American pragmatist Richard Rorty and the French analytic philosopher Pascal Engel present their radically different perspectives on truth and its correspondence to reality. Rorty doubts that the notion of truth can be of any practical use (...) and points to the preconceptions that lie behind truth in both the intellectual and social spheres. Engel prefers a realist conception, defending the relevance and value of truth as a norm of belief and inquiry in both science and the public domain. Rorty finds more danger in using the notion of truth than in getting rid of it. Engel thinks it is important to hold on to the idea that truth is an accurate representation of reality. In Rorty's view, epistemology is an artificial construct meant to restore a function to philosophy usurped by the success of empirical science. Epistemology and ontology are false problems, and with their demise goes the Cartesian dualism of subject and object and the ancient problematic of appearance and reality. Conventional "philosophical problems," Rorty asserts, are just symptoms of the professionalism that has disfigured the discipline since the time of Kant. Engel, however, is by no means as complacent as Rorty in heralding the "end of truth," and he wages a fierce campaign against the "veriphobes" who deny its value. _What's the Use of Truth?_ is a rare opportunity to experience each side of this impassioned debate clearly and concisely. It is a subject that has profound implications not only for philosophical inquiry but also for the future study of all aspects of our culture. (shrink)

It has recently been argued that normative considerations play an important role in causal cognition. For instance, when an agent violates a moral rule and thereby produces a negative outcome, she will be judged to be much more of a cause of the outcome, compared to someone who performed the same action but did not violate a norm. While there is a substantial amount of evidence reporting these effects, it is still a matter of debate how this evidence is to (...) be interpreted. In this paper, we engage with the three most influential classes of explanations, namely, (a) the Norm‐Sensitive Cognitive Process View, (b) the Normative Concept View, and (c) the Pragmatics View. We will outline how these theories explain the empirical results and in what ways they differ. We conclude with a reflection on how well these strategies do overall and what questions they still leave unanswered. (shrink)

Le mieux, depuis que nous avons perdu le (...) souci de fonder nos croyance sur des raisons ultimes, serait, tout simplement, de ne pas se soucier des questions du sceptique. Ce que l'on sait dépend, nous dit-on, des circonstances, et toutes nos connaissances sont faillibles. N'y a-t-il pas plutôt des savoirs, dont l'histoire nous montre combien leurs modes de validations sont variés? Ce livre entend refuser ce type de réponse contextualiste et relativiste. Il propose de revenir à la réponse de sens commun de Moore, à partir des reformulations contemporaines des raisonnements sceptiques issues de la philosophie analytique de la connaissance. Personne ne peut nous envoyer savoir quelque chose que nous ne pourrions pas savoir. De fait, nous savons, mais notre savoir n'est pas transparent : nous n'avons pas besoin de savoir que nous savons. Pour parvenir à cette réponse, il faut replacer la notion de connaissance, plutôt que celle de croyance justifiée ou rationnelle, au centre de l'épistémologie, et reformuler des questions traditionnelles comme celles de la nature de la perception, du témoignage, et de la connaissance a priori. Since its origin, bioethics has attracted the collaboration of few social scientists, and social scientific methods of gathering empirical data have remained unfamiliar to ethicists. Recently, however, the clouded relations between the empirical and normative perspectives on bioethics appear to be changing. Three reasons explain why there was no easy and consistent input of empirical evidence into bioethics. Firstly, interdisciplinary dialogue runs the risk of communication problems and divergent objectives. Secondly, the social sciences were absent partners since the beginning of (...) bioethics. Thirdly, the meta‐ethical distinction between ‘is’ and ‘ought’ created a ‘natural’ border between the disciplines. Now, bioethics tends to accommodate more empirical research. Three hypotheses explain this emergence. Firstly, dissatisfaction with a foundationalist interpretation of applied ethics created a stimulus to incorporate empirical research in bioethics. Secondly, clinical ethicists became engaged in empirical research due to their strong integration in the medical setting. Thirdly, the rise of the evidence‐based paradigm had an influence on the practice of bioethics. However, a problematic relationship cannot simply and easily evolve into a perfect interaction. A new and positive climate for empirical approaches has arisen, but the original difficulties have not disappeared. (shrink)

These replies to commentators on my work focus on the nature of epistemic norms, on the nature of truth and on the nature and value of knowledge. A normative account of belief and knowledge is committed to substantial and objective epistemic norms. But not everyone agrees on their form. I try here to reply to some doubts raised by my critics.

The omission effect, first described by Spranca and colleagues, has since been extensively studied and repeatedly confirmed. All else being equal, most people judge it to be morally worse to actively bring about a negative event than to passively allow that event to happen. In this paper, we provide new experimental data that challenges previous studies of the omission effect both methodologically and philosophically. We argue that previous studies have failed to control for the equivalence of rules that are violated (...) by actions and omissions. Once equivalent norms are introduced, our results show that the omission effect is eliminated, even if the negative outcome of the behavior is foreseen and intended by the agent. We show that the omission effect does not constitute a basic, moral disposition but occurs exclusively in complex moral situations. Building on these empirical results, we cast doubt onto two influential explanations of the omission effect, the Causal Relevance Hypothesis and the Overgeneralization Hypothesis, and provide a novel explanation of the phenomenon. Furthermore, we discuss various ramifications of the interplay between our understanding of omissions and legal systems. (shrink)

Ownership is universal and ubiquitous in human societies, yet the psychology underpinning ownership intuitions is generally not described in a coherent and computationally tractable manner. Ownership intuitions are commonly assumed to derive from culturally transmitted social norms, or from a mentally represented implicit theory. While the social norms account is entirelyad hoc, the mental theory requires prior assumptions about possession and ownership that must be explained. Here I propose such an explanation, arguing that the intuitions result from the interaction of (...) two cognitive systems. One of these handles competitive interactions for the possession of resources observed in many species including humans. The other handles mutually beneficial cooperation between agents, as observed in communal sharing, collective action and trade. Together, these systems attend to specific cues in the environment, and produce definite intuitions such as “this is hers,” “that is not mine.” This computational model provides an explanation for ownership intuitions, not just in straightforward cases of property, but also in disputed ownership (squatters, indigenous rights), historical changes (abolition of slavery), as well as apparently marginal cases, such as the questions, whether people own their seats on the bus, or their places in a queue, and how people understand “cultural appropriation” and slavery. In contrast to some previous theories, the model is empirically testable and free ofad hocstipulations. (shrink)

Sosa takes epistemic normativity to be kind of performance normativity: a belief is correct because a believer sets a positive value to truth as an aim and performs aptly and adroitly. I object to this teleological picture that beliefs are not performances, and that epistemic reasons or beliefs cannot be balanced against practical reasons. Although the picture fits the nature of inquiry, it does not fit the normative nature of believing, which has to be conceived along distinct lines.

The present paper investigates the nature of norms in correlation to the philosophical notions of intentionality and disposition. Following Amselek (2017; 2020), norms are here understood as tools giving the measure of what is possible to do. Intentionality, understood as “being-about”, in relation to norms allows us both to form a description of reality in the norm, and to correct our actions in order to correspond to the norm. Through the notion of disposition, i.e., on the one hand, the linguistic (...) manifestation of the norm and, on the other hand, the physical presence of individual mental states or social states-of-affairs, the paper investigates the “force of norms” and the “mystery of effectiveness”. Elaborating on the notion of “nomotropism”, which highlights the different ways in which a norm may work or operate, and drawing inspiration from Dennett’s philosophy of mind, the paper suggests that legal norms, which allow for the expectation that social behaviors will be measured by specific standards or yardsticks, clearly offer an evolutionary advantage in the regulation of human relationships. The knowledge account of assertion (KAA) is the view that assertion is governed by the norm that the speaker should know what s/he asserts. It is not the purpose of this article to examine all the criticisms nor to try to give a full defence of KAA, but only to defend it against the charge of being normatively incorrect. It has been objected that assertion is governed by other norms than knowledge, or by no norm at all. It seems to (...) me, however, that a number of these criticisms are based on a number of misunderstandings of the notion of a norm and of the way it can regulated a given practice. Once we spell out in what sense knowledge can play a normative role in this context, the KAA appears much more plausible. (shrink)

I raise a dilemma for an epistemology based on the idea that there are hinge propositions or primitive certainties: either such propositions are norms or rules in the 'grammatical' sense, but they cannot regulate our inquiries since they are not genuine propositions obeying truth or evidential standards, or they are epistemic norms, but compete with the classical norms of belief and knowledge. Either there are hinges, but they have nothing to do with epistemology, or hinges are part of our knowledge, (...) and their epistemology is part of ordinary epistemology. (shrink)

Commentators discussed the coherence and validity of a minimalist approach to ownership intuitions, in ways that make it possible to clarify the model, re-evaluate its cognitive underpinnings, and sketch some of its implications. This response summarizes the model; addresses issues concerning the need for a special technical lexicon when describing cognitive semantics; the psychology involved in contexts of competitive acquisition and their consequences for possession and use of rival resources; the role of cooperative expectations in creating mutually beneficial allocation of (...) resources; the consequences of ownership psychology for social interaction and the production of social norms of property; and the relations between psychological processes and legal institutions in the domain, before proposing some final thoughts. Hòa Hảo Buddhism belongs to that traditional lay and frugal buddhism encouraging practicing at home (tu tại gia) while being engaged with the world (nhập thế). It appeared in Southern Vietnam at the end of the 1930’s. Obviously, colonial contest and economic depression have played the part of a powerful catalyst in the spread by a young charismatic and reformist character of this millenarianism. Then, during three decades of postcolonial and cold wars (1945–1975), this New Religious movement hardly expressed its (...) Buddhist ethic of social statements in order to lend moral support and material protection to the local peasantry. Eventually, at the end of the war, this autonomous Buddhist community finally tried to morph again into a legal religion at a time when the Vietnamese Communist Party had to urgently impose a new sovereign socialist republic (1976). In other words, the new regime had to reunify the Nation and build a new secular state. In the southern part of the country, the replacement of a former liberal regime (Republic of Vietnam) by a socialist republic (called formerly a Democratic Republic in Northern Vietnam) completely changed the nature of the State-Church relations. Therefore, many religious groups’ agencies suffered a drastic blow as these groups were subordinated to the Patriotic Front and its mass organizations. Nevertheless, in 1991, the reorientation of the religious policy officially reaffirmed the religions’ social utility. Since then, new debates emerged to define the nature of the social actions of religious groups and then to delineate the legal sphere of their activities in this secular state. This essay intends to question how the two notions of being engaged with the world (nhập thế) and that of the secular state (nhà nước trung lập thế tục) interacted during these last decades. To tackle this pivotal issue, we focused on the specific implementation of Hòa Hảo social activism, from 1940’s until now, to underline how this activism evolved under different political regimes and how a new culture of social service has been promoted since the Hòa Hảo official church was recognized in 1999 and achieved years later. It questions more generally how religious groups can negotiate with the state for the emergence of a civil society or, at least, for the acceptance of their own tribute to the prosperity of the Nation. In this critical introduction to contemporary philosophical issues in the theory of truth Pascal Engel provides clear and authoritative exposition of recent and current ideas while providing original perspectives that advances discussion of the key issues. This book begins with a presentation of the classical conceptions of truth - the correspondence theory, the coherence theory and verificationist and pragmatist accounts - before examining so-called minimalist and deflationist conceptions that deny truth can be anything more than a thin concept holding (...) no metaphysical weight. The debates between those who favour substantive conceptions of the classical kind and those who advocate minimalist and deflationist conceptions are explored. Engel argues that, although the minimalist conception of truth is basically right, it does not follow that truth can be eliminated from our philosophical thinking as some upholders of radical deflationist views have claimed. Questions about truth and realism are examined and the author shows how the realism/anti-realism debate remains a genuine, meaningful issue for a theory of truth and has not been undermined by deflationist views. Even if a metaphysical substantive theory of truth has little chance to succeed, Engel concludes, truth can keep a central role within our thinking, as a norm or guiding value of our rational inquiries and practices, in the philosophy of knowledge and in ethics. In this brilliant essay, Jacques Derrida explores issues of vision, blindness, self-representation, and their relation to drawing, while offering detailed readings of an extraordinary collection of images. Selected by Derrida from the prints and drawings department of the Louvre, the works depict blindness—fictional, historical, and biblical. From Old and New Testament scenes to the myth of Perseus and the Gorgon and the blinding of Polyphemus, Derrida uncovers in these images rich, provocative layers of interpretation. For Derrida drawing is itself blind; (...) as an act rooted in memory and anticipation, drawing necessarily replaces one kind of seeing with another. Ultimately, he explains, the very lines which compose any drawing are themselves never fully visible to the viewer since they exist only in a tenuous state of multiple identities: as marks on a page, as indicators of a contour. Lacking a "pure" identity, the lines of a drawing summon the supplement of the word, of verbal discourse, and, in doing so, obscure the visual experience. Consequently, Derrida demonstrates, the very act of depicting a blind person undertakes multiple enactments and statements of blindness and sight. _Memoirs of the Blind_ is both a sophisticated philosophical argument and a series of detailed readings. Derrida provides compelling insights into famous and lesser known works, interweaving analyses of texts—including Diderot's _Lettres sur les aveugles_, the notion of mnemonic art in Baudelaire's _The Painter of Modern _ _Life_, and Merleau-Ponty's _The Visible and the _ _Invisible_. This paper analyses Davidson's conception of the norms of rationality which govern, according to him, the interpretation of mind and action. While I accept Davidson's thesis that there are norms of the mental, I disagree with him on their scope. It is argued that there are much more specific norms for concepts, and that belief in partiuclar is governed by a norm of truth.

ABSTRACT: In the first part of this paper, I criticize the indexical interpretation of meta-ethical relativism. According to the indexical interpretation, the content of a moral statement varies with the context of its utterance. I argue that such an interpretation is not empirically plausible, and that it cannot explain the seriousness of radical moral disagreements. In the constructive part of the paper, I offer an alternative, minimalist interpretation of moral relativism, which is based upon an analogy with the case of (...) the relativity of motion. There are three strands for reading the famous equation that a theory of meaning is a theory of understanding. One can give precedence to the theory of meaning, holding that what the speaker understands is such a theory. This is Davidson's stance. One can hold that understanding comes first and have a psychology of meaning. This the cognitivist stance. Or one can hold that there is no priority of meaning over understanding and vice versa. Pasolini’s protean oeuvre focuses particularly on lives outside the conventional class system and its norms. This text examines how one might envisage the organization of the multitudes in light of the practices developed by Pasolini to treat these singular forms of life. It reveals the ethical coherency of the «free indirect discourse » that Pasolini deploys in the context of the ideological and linguistic normalization that emerged from Italian fascism and neocapitalism.

A number of writers have attempted, since Mach, Boltzman and the psychologists of the end of the XIXth century, to give an evolutionary account of logical norms. Husserl famously argued that this account fails, for it is circular. I examine here some recent accounts, based on evolutionary psychology and game theory, in particular those of Gibbard, Millikan and Cosmides-Tooby. I argue that they suffer for similar circularities, although an evolutionary account of the cognitive mecanisms which underlie logical norms is feasible.

This paper examines a passage of the eleventh chapter of the Rigs gter of Sa skya Paṇḍita on the division of arguments by consequence of the form “Because S is P, it follows that it is Q” with respect to the type of relation between P and Q. This passage appears in quite different versions in several available recensions of the Rigs gter, all of which are problematic to some extent. The different interpretations of the commentators can be shown to (...) derive from their reliance on different versions of the text, which they strove to make sense of through two distinct strategies. Following up on the examination of a division of arguments by consequence along the same line in the works of Sa skya Paṇḍita’s Tibetan predecessors, in particular Phya pa Chos kyi seng ge and mTshur ston gZhon nu seng ge :883–938, 2016b), I evaluate the diverging versions of the Rigs gter against a coherent logical scenario founded on Sa skya Paṇḍita’s discussion pertaining to the types of logical reasons in inference in the tenth chapter of his work and comparison with the classification by Phya pa. I offer a hypothesis regarding the genesis of the problematic versions of the passage on the classification of consequences in the Rigs gter based on the comparison with the classification found in mTshur ston’s epistemological work. I propose that the composition of this portion of the Rigs gter might have involved a textual reuse of mTshur ston’s classification, even though mTshur ston and Sa skya Paṇḍita disagree on background issues. This very disagreement imposed changes to the reused text that led to problematic readings. (shrink)

It is a common view that Ockham’s critique of Scotus’s position on the issue of contingency is “devastating,” for it seems obvious that a possibility that does notactualize is simply no possibility. This rejection however does not commit Ockham to necessitarism, for the consideration of the temporal discontinuity of volitions should suffice to save contingency. But does it? Is it the case that diachronic volitions (which Scotus also acknowledges) are sufficient?This essay argues that (1) the debate between Ockham and (...) Scotus is not to be reduced to a logical disagreement (Scotus’s and Ockham’s modal logics are actually substantially similar) but is properly ontological inasmuch as it concerns the reduction and eventual identification of being with actuality and of actuality with reality in the sense of manifest; (2) the retrograding movement of truth from the present (Ockham’s 3rd suppositio) entails a temporal gap between present and future; and (3) Ockham’s solution depends on a conception of the will that cannot simply be identified with, and accounted for in terms of successive volitions. This article discusses the relation between empirical and normative approaches in bioethics. The issue of dwarf tossing, while admittedly unusual, is chosen as a point of departure because it challenges the reader to look with fresh eyes upon several central bioethical themes, including human dignity, autonomy, and the protection of vulnerable people. After an overview of current approaches to the integration of empirical and normative ethics, we consider five ways that the empirical and normative can be brought together to (...) speak to the problem of dwarf tossing: prescriptive applied ethics, theoretical ethics, critical applied ethics, particularist ethics and integrated empirical ethics. We defend a position of critical applied ethics that allows for a two-way relation between empirical and normative theories. Against efforts fully to integrate the normative and the empirical into one synthesis, we propose that the two should stand in tension and relation to one another. The approach we endorse acknowledges that a social practice can and should be judged both by the gathering of empirical data and by normative ethics. Critical applied ethics uses a five stage process that includes: (a) determination of the problem, (b) description of the problem, (c) empirical study of effects and alternatives, (d) normative weighing and (e) evaluation of the effects of a decision. In each stage, we explore the perspective from both the empirical (sociological) and the normative ethical point of view. We conclude by applying our five-stage critical applied ethics to the example of dwarf tossing. (shrink)

Cet article traite de deux expériences muséales portées par des entreprises, mais qui pour autant ne se présentent et ne se pensent pas comme des « musées d’entreprises ». Il s’agit du Musée EDF Electropolis à Mulhouse et de la Cité des Télécoms à Pleumeur-Bodou. Derrière se tiennent deux entreprises aux histoires assez parallèles, quoique décalées dans le temps : EDF et France Telecom , toutes deux sont des opérateurs de services publics en réseaux, avec leurs spécificités opérationnelles et, du (...) coup, patrimoniales. Devenues propriété de l’État, elles ont connu une situation de monopole avant d’être confrontées à un changement de statut et, concomitamment, à la concurrence, ce qui n’a pas manqué de renouveler la question de leur identité et de réinterroger leur soutien à des musées dont elles étaient, en partie mais pas exclusivement, le sujet.This article investigates two museums which, although established by utility companies, were not intended as corporate museums: EDF’s Electropolis museum at Mulhouse and the Cité des Télécoms at Pleumeur-Bodou. Behind these museums are two companies with a parallel though not entirely contemporaneous history: EDF and France Telecom . Both were established as public utility companies, with their own specific methods of operation, and thus formed part of the national heritage. On becoming state-owned, they effectively exercised a monopoly until the change in their status forced them into a competitive environment – which necessarily raised the issue of their identity as well as new questions on their support to museums that were partly, but not exclusively, dedicated to them. The doxastic zoo contains many animals: belief, acceptance, belief in, belief that, certainty, conjecture, guess, conviction, denial, disbelief in, disbelief that, judgment, commitment, etc. It also contains belief’s “strange bedfellows”: credences, partial beliefs, tacit beliefs, subdoxastic states, creedal feelings, feelings of knowing, in-between believings, pathological beliefs, phobias, aliefs, delusions, biases, besires. How to order the zoo? I propose to distinguish doxastic attitudes from non-doxastic epistemic attitudes. The criterion is the existence of correctness conditions. Most bedfellows do not have such normative (...) conditions. So they should not be allowed in the Doxastic Club. (shrink)

The current literature on environmental sustainability acknowledges that habits are often shaped in private life and that experiences with environmental activities in a non-work setting positively influence environmental behaviors in the work domain. However, the conditions that lead individuals to behave responsibly at work based on their environmental commitment outside the workplace remain poorly understood. We address this issue by pursuing two objectives. First, we outline archetypes of environmental behavior on and off the job and classify individuals into four (...) profiles: Apathetic, Conformist, Citizen and Enthusiast. Second, we examine a set of organizational and psychological variables that explain the likelihood of behaving in accordance with the principles of an archetype in terms of pro-environmental behavior at work. Our findings show that supervisory support, job self-efficacy and affective commitment increase the likelihood of being green at work but that environmental management practices do not. The results differ according to the profiles identified, allowing a better understanding of employees’ commitment to environmental sustainability. We conclude the paper by discussing the theoretical and managerial implications of our findings. (shrink)

Tadeusz Kotarbiński never formulates explicitly the project of an intellectual ethics, but we can reconstruct his answer from his Traktat o dobrej robocie (1955; Eng. transl.: Praxiology: An introduction to the Sciences of Efficient Action, 1965) and his ethical writings. Kotarbiński does not formulate an explicit meta-ethics of values, and seems to develop a purely functionalist conception according to which there is nothing more in intellectual ethics than a conception of efficient action. However, he has a theory of practical values (...) and skills that can be applied to the aims and norms of the epistemic domain. But can he secure a genuine conception of intellectual values if these are merely immanent to “efficient work”? (shrink)

The relation between extension and impenetrability is a major issue in the Descartes-More correspondence, which implies an analysis of the concept of extension. The mereological structure partes extra partes is a crucial element here. Both philosophers hold two opposed views of this mereological structure. I try to show that these two views can be traced back to scholastic discussions on quantity’s relation to extension. This background provides a vantage point, which enables to propose a new construal of the argumentative (...) exchange around impenetrability, and which casts some light too on our understanding of two properties – spissitude and indiscerpibility – which More attributes to spiritual extension in his later writings. This chapter evaluates Davidson's influence on contemporary philosophy. Although a number of his views on meaning, truth, interpretation, action, and mind have often been rejected within contemporary philosophy, most of most his central themes and basic concepts are still with us and have had a lasting influence. The heritage of Davidson's philosophy lies in the capacity of contemporary philosophers to modify his views and to expand them in new directions.

A course focusing on ethical issues in physics has been taught to undergraduate students at Eastern Michigan University since 1988. The course covers both responsible conduct of research and ethical issues associated with how physicists interact with the rest of society. Since most undergraduate physics majors will not have a career in academia, it is important that a course such as this address issues that will be relevant to physicists in a wide range of job situations. ABSTRACT:The purpose of this paper is to critically evaluate the instrumental perspective on Corporate Social Responsibility (CSR) in practice and theory by relying on sociological analyses of a well known organization: the Italian Mafia. Legal businesses might share features of the Mafia, such as the propensity to exploit a governance vacuum in society, a strong organizational identity that demarcates the inside from the outside, and an extreme profit motive. Instrumental CSR practices have the power to accelerate a firm's transition to (...) Mafia status through its own pathologies. The boundaries of such instrumentalism are explored and lessons for future CSR research derived, with specific emphasis on a firm's social and normative embeddedness, taking into account the inherent challenge of regulating corporate behaviour in the global economy. It is surprisingly difficult to justify private property. Two questions are at stake: (a) a metaphysical and juridical one concerning the nature of property and (b) an ethical one concerning our attitude toward wealth. This issue reached an unprecedented importance during the 12th and 13th centuries as a new moral ideal emerged. This essays analyses the controversy (with emphasis on Bonaventure’s Defense of the Mendicants) by first locating it in relation to the philosophical and theological authorities as well as (...) the Roman law. It argues that the dispute between the defenders of paupertas altissima and their opponents concerns the limit of the law. Gerard of Abbeville and John XXII saw a contradiction in a right to use that would exclude ownership. Yet, what the Franciscans were seeking was use without right. To relate to the world as something that is essentially inappropriable is to seek a form of life (a rule) prior to the law. Centuries after, such a possibility remains to be discovered. (shrink)

Is there such a thing as free belief? This paper is not about free expression of belief or free speech. It is about freedom of belief as a mental state. In the sense in which the believer would be the cause of his or her own belief, and could believe at will, it is, for well-known reasons, impossible. Some writers, however, like McDowell, have argued, in a Kantian spirit, that obeying the norms of thought and setting oneself as a member (...) of the "space of reasons" could provide the appropriate notion of free belief. Their account is based on the idea that a reflexive believer is automatically a free believer. I argue that this is wrong. There is no appropriate notion of free belief in this sense, although this does not show that one cannot be responsible for one's belief. (shrink)
